Various Types Of Intellectual Property

Tangible assets like a shop, jewellery, money, investments, vehicles etc are not the only types of property that one can possess and claim protection under the law. There are other kinds of property too which are recognized by law and protected within the legal provisions and these are called intellectual property, which can be protected against infringement. The three primary kinds of intellectual property rights are patents, trademarks and copyrights.

When an author has brought out an original composition, he or she owns the copyright over this piece and is granted protection for them. This right may be awarded for music, films, videos and other forms of artistic expressions and not just the written or printed material. Under copyright law, the creator of the work gets a number of rights which include financial rights to income arising from the work and acceptance as sole owner of that work.

On the other hand, trademarks give the one who has registered it, the protection over certain symbols, text or marks which point to the creator or origin of products to thwart replication and thus infringement. With this legal provision, trademark is safeguarded from replication by unscrupulous elements who want to exploit established brands.

The third kind of intellectual property right, known as patent, protects the rights of inventors in their innovative and useful invention. Patents are valid for a predetermined period within which the holder can enforce his exclusive right to sale and other commercial use of his invention.

There are some other less frequently found kinds of intellectual properties that can be owned by people. To cite some examples of these rare intellectual properties, they can be some special understanding carried forward by a particular family only; company secrets like recipes behind successful products; and location based symbols or marks to refer to a product which comes from that location, like Champagne.

Though these types of intellectual property are distinct from each other there are some similarities between the three. All of these are protected within the provisions of the law and the rightful holders can take refuge in a court of law and claim compensation in case of any infringement.
